DOJ moves to dismiss Proud Boys and Oath Keepers seditious convictions

On April 14, 2026 the Justice Department filed a motion with the U.S. Court of Appeals for the D.C. Circuit asking the court to vacate seditious conspiracy convictions of Proud Boys and Oath Keepers members tied to the January 6, 2021 Capitol attack. The convictions were federal seditious conspiracy verdicts that prosecutors secured against leaders and members for coordinating efforts to stop Congress from certifying the 2020 election. If the appeals court grants the DOJ motion the convictions would be vacated and could lead to defendants being released, resentenced, or retried as the litigation continues.
