James Comey faces second indictment, legal experts condemn
Acting Attorney General Todd Blanche's Justice Department charged former FBI director James Comey with threatening President Donald Trump over a 2025 Instagram post that showed seashells arranged to read "86 47." Comey surrendered to authorities and made an initial court appearance in North Carolina. Prosecutors say the "86 47" phrase expressed intent to do harm, but legal and former Justice Department officials condemned the indictment as politically motivated and said prosecutors will face an uphill battle proving criminal intent after a prior related prosecution failed. The case matters because it will determine whether slang and symbolic social media content can meet the legal standard for a threat and because it raises questions about potential politicization of the Justice Department.
GOP Rep. Don Bacon on the new Comey indictment: "I think it's foolish. It's overreach. Most Americans don't like seeing lawfare."
say it on fox news
And yet he keeps voting the party line.
Most Americans also don’t like seeing a pedophile as president.
They can indict Comey over seashells, but they cant indict trump with over 20 eye witnesses. Or thousands of TV viewers? Our government is broken and we may need to physically kick these people out after the elections. #itsriggedalrigth
His party ran on conducting lawfare, under the pretense that it was fighting lawfare. The difference is the last admin was securing convictions because they actually committed crimes. They were so incensed they were being held accountable they are making up crimes to prosecute back
More Bacon: "And I'm so mad about it I'm going to do absolutely nothing, then vote for Trump's ballroom and whatever else he wants, then retire." He's the House version of Susan Collins. Always concerned, but never enough to actually do anything about it. A useless waste of congressional space.
F’er just dropped that “both sides” in there like slipping in a roofie.
Unfortunately Trump doesn’t care what most Americans like
Zero pedophiles have been indicted since King Pedo took office.
I don't understand why the few Republicans who don't affirmatively seek to harm Americans and abuse our kids and throw people in concentration camps still remain Republicans. It's inexplicable.
Wait til Don gets back to he office and sees the email chain from his unhappy boss over this interview
Bacon falsely claimed that a few administrations have done this. He's leaving congress yet he still lies for Trump. The investigations & prosecutions of Trump were righteous. Don Bacon is a liar. He's scared of Trump. He was a 1 star general. He's disgraced his uniform. Truly pathetic.
The "American🇺🇸 Dream" is a nightmare!
There were probably 100’s of “86 46” out there, many tailgate wraps with Biden trussed up like a calf, did I miss the many lawsuits filed back then? No? So they’re just okay with it as long as Democrats are the target 🎯
What?! Was that actual, sensible words from Don? Stepping outside to check earth core temperatures...
So brave since bacon is retiring
Foolish? Overreach? No. It’s criminal.
The inbred enjoy it. Ask any MAGA
People are tired of the Darth Cheeto revenge tour
So tell your orange master! 🤡
This lawsuit is another waste of taxpayer money
oof House R's trashing admin moves the next day on CNN, how far the cult of donny has fallen
It's not for "most Americans." It's for one.
Wow. When you've lost Rep. Troy Nehls (R-TX). "You can indict anybody...Listen, it's a stretch. It's a stretch," Nehls says about the Comey indictment. @macfarlanenews.bsky.social on the Hill for MTN.
NO, it's not a stretch. It's prosecutorial misconduct.
When does the prosecution of Jack Prosodic begin? Doesn't his 8646 tweet count?
What does he mean, you can't find an honest judge or jury in New York??? sickening
This makes dirty cops like Troy nervous. Just think what we could do to real corruption vs free speech?
Nincompoop Nehls Real sharp legal mind here "Is it criminal?" "If you can FIND a jury to convict him..." Lots of integrity here, too 🙄
Amazing. The biggest ass-kisser in Congress has a tiny moment of clarity. Probably the most insightful thing he's ever said.
Insulting NYC and DC in his answer.
Hopefully more & more Refuckkklicans will jump ship!
How may republicans tweeted out photos of Hillary or Obama in crosshairs? Trump himself said “By the way, and if she (Hillary Clinton) gets to pick her judges, nothing you can do, folks. Although the Second Amendment people, maybe there is.” That sounds more like an assassination order than 8647.
The ham sandwich is laughing it’s ass off!
These are the idiots we idiotic Americans are electing to office. Do better, Texas.
WTF it’s a stretch!!! Lawyers should be disbarred for this BS!
Nehls Is free to speak his mind as he’s leaving office at the end of 2026.
He sure said a lot to simply say “it’s bullshit”
Comey seashell indictment is an abuse of power by DOJ. My thoughts in @msnownews.bsky.social www.ms.now/opinion/jame...
Completely! This mfkr did hand the pedophile the 2016 election though, so I am having a hard time giving a fuck about the fact that the monster he created is trying to ingest him...🤷🏽♀️
. Comey needs to be indicted on announcing a "new investigation" on Hillary Clinton days before the election. That cost her the election. >>> Election Interference <<<
I’m 56 years old. I’ve followed this stuff closely for more than 40 years now. And I cannot believe I’m living in an era this catastrophically stupid.
Of course, anyone can see that the government has no case against Comey &this is just targeted harassment, plain and simple. But can someone please explain to me how there could be such a group of morons that they indicted Comey for a seashell pic?!?
And it appears we may have the 'second coming' of Lindsey Halligan in the driver's seat.
Can you charge someone for a term that is so open to interpretation? bsky.app/profile/wisa...
Merriam Webster: Eighty-six is slang meaning "to throw out," "to get rid of," or "to refuse service to." It comes from 1930s soda-counter slang meaning that an item was sold out.
So the shotgun was never fired, apparently. The indictment is a lie. And three days later they still won’t say how the Secret Service officer was shot. (But they did indict Comey for his seashells.) Trust much? www.washingtonpost.com/investigatio...
It was friendly fire…the suspect wasn’t interested in shooting at law enforcement…he was trying to get to trump. We can’t trust a word that comes from this administration— on the war, on Epstein, on immigration, on the environment, on crypto. On any topic, we get lies and self-dealing corruption.
The goal is the 24/7 headlines parroting Trump's claims against Democrats in General, as if every Dem was in on it. Just like what is happening previously, investigations are turning quiet on previous Trump encounters.
They won’t “investigate“ because it wasn’t part of the script.
James Comey committed no crime. The judge could just take judicial notice of the dictionary definition of the slang term "86." Motion to dismiss, granted.
That’s a relief. Otherwise this horse is up shits creek 😂
Why is there no punishment for the people that filed these frivolous charges? If there is no punishment, then that is a guarantee they will do it again.
Nothing Burger. Wake me up when Vindictive Prosecution comes into play.
Even if it meant what DOJ contends, posting a photo of it is not a crime. Putting shells in the shape of 8647 is not a crime, either.
Comey's lawyers can (will) easily argue that it's selective prosecution, using Trump's own social media posts as exhibits. The indictment will get dismissed in one day.
I hope it goes to trial. Put it on CSPAN.
In hockey they would call the lawsuit embellishment and would call a penalty! trump should have to pay for his frivolous lawsuits clogging the courts.
Hey Glenn, hope you’re keeping well. ⚖️
ICYMI, I wrote up the ludicrous Comey indictment yesterday. Something to notice in the coverage and commentary, particularly from the justifications for the indictment: the distinction between threats and incitement. /1 www.popehat.com/p/the-comey-...
/2 The Comey indictment is charged as a threats case. The nature of a threats case is an accusation that a person made a statement that a reasonable listener familiar with the context would interpret as a sincere expression of intent to do harm, combined with a level of intent.
He might incite me to go to the beach, I guess....
Incitement like “you need to fight like hell” that kind of incitement?
How the hell did they get a grand jury to fall for this crap
If she sells seashells by the sea shore, can she be charged with providing material support for making threats?
I bought an "8647" shirt from Teepublic this morning just because.
One cannot shame the shameless.
I had 8645 stickers on my truck (now removed, due to vandals) I had a t-shirt, are they going to arrest me for threatening the orange shitstain? Fuck this admin and fuck the FBI, which is now just a building full of dirty cops and dirty lawyers.
The picture of the US Attorney in the bio page you linked to is hilarious. He is clearly trying AS HARD AS HE CAN to mimic Trump's "serious scowl" and not remotely pulling it off.
NEW: Former prosecutors SHELLSHOCKED by how weak the James Comey indictment is.
BUILT ON SAND, they might say.
One Etsy seashell artist on that jury and they're done.
Trump is doing multi-generational damage to our criminal justice system.
The courts have to start ordering the prosecutors to pay for all expenses including lawyer fees to those who have been wrongly indicted for revenge by Trump.
The point of these indictments is not to get criminal convictions. The point is to tell the world they’ll indict anyone who pisses them off. It’ll cost you $100k in legal fees to fight even a garbage indictment.
Of course, the indictment is weak. It’s a revenge indictment pushed by the convicted felon in the oval office!
Dear James Comey, sue this pathetic, imbecilic administration for $1 trillion.
quite the stretch for the Justice Department…hope they don’t pull a mussel
This just shows how vile this administration under Trump is. Prices on everything is sky rocketing, people are losing their jobs, farmers are hurting, and all Americans are struggling to stay afloat; yet they continue to go after Comey. We need a change in leadership!!!
There’s no real case here against James Comey and Trump knows it. This isn’t about winning. It’s about the spectacle, the cameras, the legal bills, and toll on Comey and his family. If this is the playbook, anyone can be targeted. This is retribution. Comey won’t be the last.
I don't get it. Donald should thank Comey every day for what he did on October 28, 2016. Comey breached the protocol, broke all the rules and, as result, was instrumental in placing Trump, Putin's asset, in our White House. And you know it all. You were a part of Trump admin until August 2020.
It’s a classic case of malicious prosecution.
Than let’s Spectate on Russia, Russia, Russia, and tRUMPs ties to Putin!
It’s just insane that Trump whined about “weaponization of the DOJ” under Biden, which didn’t happen. And then now the obvious and blatant abuse of the DOJ for revenge. Insane.
Release the unredacted Epstein files. Now. No more stupid distractions.
NEW: James Comey posted a picture of seashells by the seashore. Trump's DOJ indicted him for it. Another Comey indictment in this altogether embarrassing day for DOJ. Also: The Second Circuit creates a circuit split, blocking the Trump admin mandatory detention policy. Tonight, at Law Dork:
Let’s all post seashells or whatever the fuck spells it out. Arrest us all.
So, hypothetically, even 86 did mean “kill” (a huge and almost certainly incorrect assumption), isn’t that STILL protected speech under Watts?
All 3 of those guys should be 86'd. They're worthless dipsheets.
The 🤡in the WH posted a photo of the Obamas dressed as gorillas. Kinda on the nose. 🦗
The legal profession has never been more embarrassed
Comey appears in court in Eastern District of VA and briefly placed under arrest. Judge permitts him to leave w/o conditions of release.Fitzgerald says will file motion to dismiss b/c vindictive prosecution. New substack discusses all: harrylitman.substack.com/p/seashellgate-is-going-exactly-nowhere
Time to 86 the SCOTUS
fucking ridiculous nonsense. Not that I feel sorry for Comey, since he helped us get here, but it is still fucking ridiculous nonsense.
More outrage theatre to soothe Trump's fragile ego. It'll go nowhere and Trump will lose. He probably already has his next phony whateverthefuck distraction in the works just to keep the Epstein Files on the back burner.
Honestly, I can't help but lose faith. The fact that at least 12 of our fellow Americans thought his post amounted to a threat on POTUS' life is disheartening and ridiculous.
If the indictment was labeled "Vindictive Prosecution Indictment," it couldn't possibly be any more clear. What a crock.
1/ This is an outstanding instant analysis of the James Comey "8647" criminal indictment by @kenwhite.bsky.social. You should go read it; it's relatively short. Ken makes two interlocking points that bear repetition. www.popehat.com/p/the-comey-...
2/ First, that it is impossible to overstate just how inarguably wrong the DOJ is; this is sovereign-citizen-level nonsense. And second, that Trump has so corrupted our politics that his sycophants inside the DOJ have already argued it - and will soon be joined by partisan lawyers who KNOW BETTER.
Todd Blanche is essentially The Grand Inquisitor of the Orange Inquisition.
Day 464 of 1462 - Bill O’Reilly “Tiller the Baby Killer” Here’s example that EVERYONE should be using for “protected free speech” Bill O’Reilly used term “Tiller the Baby Killer” to describe, Dr. George Tiller, Kansas abortion doctor In 2009, Tiller MURDERED attending CHURCH by abortion extremist
Two former federal prosecutors kick around the Comey indictment. Come get all the details you need to be up to speed. @preetbharara.bsky.social calls it shameless—and shameful. open.substack.com/pub/joycevan...
If I was Comey's defense lawyer. I'd bring in a bunch of restaurant folks and ask them if to 86 a menu item means "remove"the steak or kill it?
Is there no law prohibiting squandering tax money on harassment indictments? Or should my loathing for the US go to 11?
Aren't they tired of it YET? He and McCabe targeted by IRS (cleared), the two indictment frauds, and for that matter, targeting his daughter for firing? I suppose not.
