James Comey faces second indictment, legal experts condemn

Acting Attorney General Todd Blanche's Justice Department charged former FBI director James Comey with threatening President Donald Trump over a 2025 Instagram post that showed seashells arranged to read "86 47." Comey surrendered to authorities and made an initial court appearance in North Carolina. Prosecutors say the "86 47" phrase expressed intent to do harm, but legal and former Justice Department officials condemned the indictment as politically motivated and said prosecutors will face an uphill battle proving criminal intent after a prior related prosecution failed. The case matters because it will determine whether slang and symbolic social media content can meet the legal standard for a threat and because it raises questions about potential politicization of the Justice Department.
