ABC argues FCC violated First Amendment in dispute over The View

ABC filed a legal challenge saying the Federal Communications Commission violated the First Amendment by probing whether The View still qualifies for its 2002 broadcast news exemption. ABC says that exemption dates to 2002 and has not been challenged in the 24 years since it was granted. The FCC escalated the matter by reviewing the licenses of all eight ABC-owned local stations years before their expiration, which ABC calls regulatory overreach. The filing was signed by a veteran Supreme Court litigator, and ABC argues a ruling for the network would curb the FCC's ability to use licensing and regulation to police programming viewpoints.
