Alberta judge quashes separation petition, cites First Nations

Justice Shaina Leonard quashed a petition seeking an Alberta separation referendum Wednesday, saying the chief electoral officer should not have issued the citizen-initiative. Leonard found Premier Danielle Smith’s government failed to meet a legal duty to consult affected First Nations and to account for treaty rights, citing challenges from the Athabasca Chipewyan First Nation and the Blood Tribe. Separatist organizers had claimed they gathered enough signatures to trigger a province-wide vote, but the judge’s ruling voids that path to a referendum for now. Alberta says it will appeal, a move that keeps the dispute in court and highlights that treaty obligations can block provincial initiatives.

This basically kills 301,000-signature petition separatists delivered to Elections AB to force referendum on independence. Great news. Only in Canada Could Indigenous groups defend the sovereignty of country that took there land from people who want to make a new country within a country so those people who originally took the indigenous land could take the indigenous territory back again. CDN needs to chill out.

This is confusing given a) the crown is not running the petition and b) i’m pretty sure the Supreme Court decision places the duty to consult before separating not before a referendum. This decisions go onto the top.

I don’t know if this quite means the petition is thrown out, or just dealt a huge blow. I was thinking before this news broke today that if there is any evidence of forged signatures on the petition, it should be thrown out, but if this is how it gets thrown out, just as well.

I always wondered if they didnt have the votes, with their need to show off the 'boxes of signatures' like props. But glad it was knocked down another way. Dani acts above the law and will of the people so I hope this ends here.

Danielle Smith could still appeal, change legislation, or just put the separatist question on the referendum anyway. Albertans can act: Write to [email protected] and call 780-427-2251 to demand she scraps the entire referendum since the separatist petition is now null & void.

Alberta will appeal, which is its right. This will go to the Supreme Court of Canada. The SCC cannot ignore the Charter of Rights and Freedoms and the Duty to Consult, which is in the Charter. 💙❤️💜The far right will start complaining about "judicial activism."
