Alberta judge quashes separation petition, cites First Nations
HUGE: Alberta judge quashes the separatists' referendum petition, in major victory for Athabasca Chipewyan First Nation and Blackfoot confederation. Justice Shaina Leonard: "the Crown failed to meet its duty to consult"
This basically kills 301,000-signature petition separatists delivered to Elections AB to force referendum on independence. Premier Smith could still call referendum as gov't act, like separatist groups want her to. But lack of Indigenous consultation would still be problem. bsky.app/profile/mark...
The Separatists are confident this will be overturned by the US Supreme Court.
Headlines from the Future, Today! This from a couple of days from now... "Danielle Smith proposes new legislation to allow separatist petition to proceed."
Should happen anyway because there is no way at least half of those signatures aren't fraudulent. They very likely used that data leak to pad it.
DaniQ Smith will still find a way to hold the referendum because Parker-brat is her best bud.
Ha!! How’s the blow up over on the former bird site going?
Thanks for sharing (In the future, please use Alt Text 🙏)
Did I misunderstand this article? www.ctvnews.ca/edmonton/art...
Great news. Only in Canada Could Indigenous groups defend the sovereignty of country that took there land from people who want to make a new country within a country so those people who originally took the indigenous land could take the indigenous territory back again. CDN needs to chill out.
Good. Rule of Law prevails.
This is confusing given a) the crown is not running the petition and b) i’m pretty sure the Supreme Court decision places the duty to consult before separating not before a referendum. This decisions go onto the top.
So, I assume this will be appealed to an Alberta court of appeals, if/when they lose there also, is the Supreme Court next?
I don’t know if this quite means the petition is thrown out, or just dealt a huge blow. I was thinking before this news broke today that if there is any evidence of forged signatures on the petition, it should be thrown out, but if this is how it gets thrown out, just as well.
🍁 BREAKING: Alberta court just threw out the separation referendum petition! First Nations legal challenge wins the day. Canada holds. One country. Always. 🇨🇦 #AlbertaSeparation #OneCanada #USDemocracy #Pinks apple.news/Adu0pFroFTBi...
The US is pushing this. Horrible
Russia was behind Brexit. Russia is behind ANY separatist movement, because it ultimately weakens power against them.
Yeah for Canada! Love our Northern neighbors, especially for stopping an awful MAGA petition.
It wasn't a very well thought of petition
BREAKING! Separatists are a bunch of but hurt ass clowns.
Lying, treasonous, unlawful, white supremist bastards! Down with them.
BREAKING: Athabasca Chipewyan FN & Blood Tribe say they've won their court challenge of the Alberta separation referendum. The Chief Electoral Officer’s decision to issue a citizen initiative petition on independence has been quashed.
"We are pleased to say that in all proceedings the First Nations were successful. Statements will be forthcoming."
Thank you First Nations....effectively saving the UCP from themselves.
Who has two thumbs and saw this coming eight months ago? [I am currently indicating myself with both of my thumbs.]
CTV is reporting they lost... www.ctvnews.ca/edmonton/art...
Does this mean the seppie referendum won't be on the ballot?
That's a major blow to Alberta's separatist movement. Indigenous communities have been vocal about the potential impacts on their lands and rights.
BREAKING! Entire Athabasca Chipewyan FN & Blood Tribe membership weirdly plunges to their death from a fourth-floor balcony. Danielle Smith insists she has an alibi.
An Alberta judge has quashed a separatist petition she said should never have been issued. Lawyers for several Alberta First Nations had argued the province’s referendum process and its use by separatists are unconstitutional, as there’s no requirement for Indigenous consultation.
Has anybody pointed out to these clowns that they can separate from Canada anytime they want? It's called "emigration".
The petitioners need to be investigated. Its treason.
Alberta minus first nations territory and federal lands ends up being the size of a walmart parking lot.
There will be some very enraged traitors today, hopefully none of them become violent.
Seeing as "manufacture a divisive referendum on Alberta separatism and then claim to be the only party able to heal the wounds you caused" is the entire plan for the UCP campaign in the October 19, 2027 election, expect to see a panicked rush to revive it from Smith's MAGA North government.
It was never going to happen, but this makes the court decision even more delicious 🤣 Decision to approve #Alberta separation petition was 'unreasonable,' judge rules Justice finds Crown didn’t meet duty to consult www.cbc.ca/news/canada/...
They must be livid. I am waiting for the whining to start up. They can blame smith. That would be fun
You can bet your Silver Dollar (if you have any) that these F*CKERS wont stop.
I always wondered if they didnt have the votes, with their need to show off the 'boxes of signatures' like props. But glad it was knocked down another way. Dani acts above the law and will of the people so I hope this ends here.
I'm so glad our Courts still work.
I told them so. I posted this just over a year ago and got so much rage from it how I was wrong.
Finally, the King’s Court acknowledges the territorial rights of Indigenous Canadians. It’s only taken 158 years.
Danielle Smith could still appeal, change legislation, or just put the separatist question on the referendum anyway. Albertans can act: Write to [email protected] and call 780-427-2251 to demand she scraps the entire referendum since the separatist petition is now null & void.
Awesome Alberta belongs to Canadians.
Hopefully, now we won't have to hear about this nonsense anymore.
A good day for Alberta
I said if they'd bothered to get a legal opinion before even starting all this, they never would have started it to begin with. The courts in this country are non-political and Scandal Smith, Fraud Ford and Moron Moe can't change that. Carney can try. He'll fail.
It’s not over yet. She’s already talking about an appeal and saying that Quebec will have an interest. So grateful for the First Nation indigenous leaders rising up against the trumpet premier.
What laws will Dumpster Dani try and change?
🤔Perhaps those separatists would like to pack their belongings and move to a red states FFS.. it is a free country after all... 🤙🇨🇦
The RCMP needs to arrest the Centurion Oroject and TBA assholes, track down the US and Russian money and expose everything. Quickly
Alberta will appeal, which is its right. This will go to the Supreme Court of Canada. The SCC cannot ignore the Charter of Rights and Freedoms and the Duty to Consult, which is in the Charter. 💙❤️💜The far right will start complaining about "judicial activism."
Nice to see a judicial system that appears to still be working.
Well, it kept them busy and out of trouble for a little while.
A court in Alberta ruled that political activists can’t proceed with a petition to force a vote on separation from Canada because the government failed to meet its obligation to consult with Indigenous people.
First ever case of Canadian courts caring about Indigenous rights.
Smith rapidly demanding legislation that requires a separation vote every 4 years saying she doesn't want it but it's the will of the people.
Of course they did. I’m sure they think Indigenous people aren’t ’real Canadians’.
Of all the things to stop the seperatist movement, I was not expecting it to be a Canadian court reminding people that the First Nations exist.
Awesome news! Thank you to the honourable Indigenous people! ❤️
I hate that Danielle Smith is appealing it.
Tomorrow is Moose Hide Campaign Day. It would be wonderful for relieved Albertans to show up at a local event.
