Bloomberg Law says White House adviser Stephen Miller was the driving force behind a Justice Department Office of Legal Counsel memo that urges overturning Olmstead v. L.C. and authorizes states to institutionalize some people with disabilities rather than fund community-based care. The memo reinterprets the Americans with Disabilities Act and the Rehabilitation Act to say federal law does not require states to ensure community integration, reversing decades of DOJ enforcement. Disability advocates say the change would put community supports that millions rely on at risk and would undermine the Supreme Court precedent guaranteeing the right to live in the community, a major rollback of long-standing civil rights protections.
