Judge rules D4vd must stand trial in Celeste Rivas Hernandez killing

Los Angeles Judge Charlaine Olmedo ruled Monday there is enough evidence to send singer D4vd, legal name David Anthony Burke, to trial for the killing and dismemberment of 14-year-old Celeste Rivas Hernandez. Prosecutors presented five days of preliminary-hearing evidence including grisly autopsy photos, explicit descriptions of sexual abuse, and the victim's final text messages; Deputy District Attorney Beth Silverman said "based on the mountains of evidence presented, all of the allegations have been proved way beyond the standard required." Olmedo found probable cause for charges of murder, continuous sexual abuse of a child under 14, unlawful mutilation of human remains, and special circumstances including lying in wait, killing for financial gain, and killing a potential witness. Burke, 21, has pleaded not guilty and was ordered held without bail; an arraignment is scheduled for August 31 and a trial could begin as soon as 60 days afterward. Los Angeles District Attorney Nathan Hochman said prosecutors presented only a small fraction of their evidence and are still weighing whether to seek the death penalty. The case began after the dismembered and decomposing body of a girl was found in the trunk of Burke's Tesla in the Hollywood Hills in September, and the ruling moves the investigation into the formal criminal trial phase.
