The Intercept Media and the Freedom of the Press Foundation sued President Donald Trump and Trump Media in U.S. District Court in Manhattan to block Truth API, a paid service that sells early, machine-readable access to Truth Social posts for up to $100,000 per month. The complaint says Trump’s posts often move financial markets and that selling preferential access to “market-moving” presidential announcements is “extraordinary, corrupt, and unconstitutional,” violating the First and Fifth Amendments. The suit notes Truth API currently delivers faster access to posts from the 10 most popular accounts on Truth Social, including the White House, Vice President JD Vance, FBI Director Kash Patel, and others, and that Trump is the largest Trump Media shareholder through the Donald J. Trump Revocable Trust. Trump Media CEO Kevin McGurn told investors the API provides public posts in milliseconds and that the company has signed more than 10 customer agreements generally in the $60,000 to $100,000 per month range. The complaint says Trump has published between 9,000 and 11,000 Truth Social posts since resuming office in January 2025 and that many of those posts are the sole source of official government news. Plaintiffs are asking the court to stop the service and bar the sale of privileged access to presidential communications.

There are (weak; unconvincing) defenses of this service…but the main takeaway is that Trump has given up on politics. “Selling access to nonpublic policy info” is a catastrophically toxic headline that wouldn’t be worth a few million dollars to someone who cared about winning elections.
