The BBC asked a US court to subpoena Donald Trump Jr., Ivanka Trump and Jared Kushner for documents and testimony as it defends against President Donald Trump’s $10bn defamation lawsuit over a Panorama edit of his 6 January 2021 speech. Court filings show BBC lawyers attempted in May to serve subpoenas in person but say service failed when a police checkpoint and the Secret Service blocked delivery at Ivanka and Kushner’s Florida home and Trump Tower staff declined or said the legal department was absent for Donald Trump Jr. The BBC argues the three have "personal knowledge" of Trump’s intentions when he revised and delivered the speech, citing evidence the congressional committee gathered that Donald Trump Jr. and Ivanka were present during revisions and that Jared Kushner drafted a proposed statement that would have condemned violence. The filing asks the court to permit service by email and certified mail and says the testimony and documents are relevant to the president’s defamation claim; a subpoena requires answering questions under oath or providing evidence and carries penalties for noncompliance. Trump sued the BBC and subsidiaries in Florida in December over the Panorama episode; the BBC has apologised for the editing error but asked the court to dismiss the lawsuit, arguing it does not meet defamation criteria and that the programme was not made available on the broadcaster’s US platforms.
