NEW: Justice Kavanaugh, on his own as circuit justice, denied the Missouri secretary of state’s application seeking to allow the state to use maps adopted by Republicans aimed at benefiting state Republicans in this election. The RNC had also backed the SoS’s request.

Not so fast: a federal judge in Missouri has now issued a conflicting ruling saying that if the new map ISN'T used it would violate the U.S. Constitution.

To be clear, this ruling is definitionally horseshit. It holds that the plaintiffs will lose their claim that the 7-1 map's districts are valid - but that Missouri must use that map anyway because it used it for the primaries and primary voters will be injured if it does not use the invalid map

If the Missouri primaries held under an illegal map are also invalid (and they are), then the fallback option is to let the parties fill the nominations, which is the mechanism Missouri law already has for cases of filling nomination vacancies, which is exactly what this is.
