Montana push aims to curb Citizens United, style political spending

politicsNov 6, 202636566

Montana activists have qualified the Transparent Election Initiative for the November 2026 ballot to limit corporate political spending by revoking corporations ability to participate in elections under state law. The proposal does not attempt to overturn the U.S. Supreme Court's Citizens United decision but instead seeks to strip corporations of election-related powers that states confer when chartering those entities. Tom Moore, a senior fellow at the Center for American Progress and former FEC counsel, lays out the legal theory in a recent paper, citing precedents dating back to 1819's Dartmouth v. Woodward to show corporations are creations of state law and hold only the powers states grant. Montana first barred corporate contributions in 1912, a restriction that remained until Citizens United; proponents argue state-level charter changes can neutralize the decision's practical effects. The initiative represents a legal strategy not previously widely tried and, if upheld, could serve as a model other states might adopt to limit corporate political spending without a constitutional amendment.

I still believe that we deserve party leaders who lead by example. I still believe we should end Citizens United. It's not within my power to choose Dem leadership and we have soooo much to do to keep our country from falling apart so I choose to chill on this for now. youtube.com/shorts/HO7Ic...
