U.S. District Judge Waverly Crenshaw dismissed two federal human-smuggling charges against Kilmar Abrego García, concluding the prosecution was vindictive and selective. Crenshaw wrote, "Because the presumption of vindictiveness remains unrebutted, the indictment must be dismissed," and cited objective evidence showing prosecutors reopened the case after Abrego sued to block his removal to El Salvador. The judge’s opinion chronicles a November 22 Tennessee traffic stop, a March 2025 DHS transfer to El Salvador, a brief April 2025 closure of the federal probe, and prosecutors reopening the investigation days after Abrego’s court victory. The ruling forces the Department of Justice to drop the case and raises questions about when prosecutors may pursue charges following defendants’ successful litigation against government immigration actions.
