Judge orders Elon Musk to give deposition in election lottery case

Magistrate Judge Susan Hightower in Austin ordered Elon Musk to sit for a sworn deposition in a fraud lawsuit over a $1 million voter giveaway run by America PAC. Two Arizona women brought the suit, saying the giveaway misled them into signing a petition and handing over personal information and that the million-dollar winners were not chosen at random. Hightower’s order requires Musk to answer on-the-record questions from opposing lawyers as part of discovery into whether the promotion amounted to unlawful voter incentives or deception. A federal judge in Texas has allowed the plaintiffs’ fraud claim to proceed while narrowing some contract-based claims, focusing the case on alleged deception rather than breach of contract. The magistrate warned that failure to comply with the deposition order could expose Musk to contempt proceedings. The deposition will provide sworn testimony about how winners were selected and how America PAC handled voter data, evidence that could determine damages or further relief in the lawsuit.
