In a June 27 broadcast interview on The Court of History, Judge J. Michael Luttig framed the Founders’ vision embodied in the Declaration of Independence and contrasted it with the current presidency, saying "the president has put forth for the American people a completely different vision for America than the vision of our founders." Luttig traced how the Declaration’s grievances and the Founders’ safeguards against tyranny remain relevant, arguing that never before until the present have so many constitutional grievances accumulated. He urged civic action ahead of July 4, telling Americans they must decide which vision of the country they want. Luttig also discussed organized legal resistance: retired federal and state judges, including efforts led by Luttig and Judge Nancy Gertner, have filed dozens of amicus briefs and other filings in cases challenging Trump-related policies and conduct. The interview paired Luttig with historians Sidney Blumenthal and Sean Wilentz, who explored the Declaration, separation of church and state, and how the Founders might view today’s institutions. Luttig closed by invoking the Declaration’s warnings about tyranny and calling on citizens and judges to uphold constitutional boundaries.
