Elias Law Group intervenes in Mississippi as Scott Colom's lead grows

newsNov 6, 20263712,826

The Elias Law Group, Marc Elias’ firm, wrote to election commissioners and circuit clerks in all 82 Mississippi counties rejecting counsel for Sen. Cindy Hyde-Smith’s demand that accepted affidavit ballots be kept segregated. The firm’s letter says Hyde-Smith’s requests have no basis in Mississippi law and warns that segregating verified affidavit ballots would threaten the secrecy of voters’ ballots and violate state procedure. The letter cites Mississippi Supreme Court guidance and Bush v. Gore to argue that disparate treatment across counties would raise equal protection and due process problems. Under Mississippi law, the note explains, once a voter returns with acceptable ID and the affidavit ballot is verified, that ballot is treated like any other; the letter also states Mississippi law does not permit recounts for U.S. Senate seats. The Elias Law Group directs counties to continue ordinary, lawful procedures and says counties must not take steps that would allow a ballot to be traced to a voter. The letter stops short of announcing litigation but signals a lawsuit could follow if counties comply with Hyde-Smith’s demand.
