Superior Court Judge Todd Edelman on Thursday permanently dismissed with prejudice the criminal case charging former Olympian David Hearn with vandalizing the Lincoln Memorial Reflecting Pool, barring U.S. Attorney Jeanine Pirro’s office from refiling the felony charge. Pirro had dropped the case on July 31 after the Interior Department produced new evidence attributing the pool lining damage to a botched, rushed contractor installation rather than Hearn’s actions. Hearn, 67, told police he was on a bike ride on June 19 when he briefly touched a peeled chunk of the pool lining at a park worker’s instruction; he had been charged with one count of property destruction that carries a maximum 10-year prison sentence. Edelman’s ruling noted the dismissal could prevent prosecutors from reviving the case amid political pressure from President Donald Trump, who publicly criticized Pirro for dropping the charge. Hearn’s lawyers called the decision “a victory for the rule of law” that lets Hearn move forward, and Pirro’s admission that the damage resulted from the renovation was described in court filings as an embarrassing setback for the White House. The ruling ends the criminal threat to Hearn and removes the prosecutor’s ability to retry or refile the same felony charge.
